1. Introduction and Acceptance

Welcome to KJClernt Games ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of the KJClernt Games platform, website, applications, and associated services (collectively, the "Platform"). By creating an account, accessing the Platform, or utilizing our Auth0 premium sign-in flow, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must immediately cease use of the Platform. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform following any modifications constitutes your acceptance of the revised Terms.

2. Account Registration and Security

To access the KJClernt Games library and experience our next-gen platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are solely responsible for safeguarding your password and for any activities or actions under your account, whether or not you have authorized such activities. We implement standard security measures, including Auth0 integration, but we cannot guarantee absolute security against unauthorized third-party intrusions. You must notify us immediately of any unauthorized use of your account.

3. Platform License and Access

Subject to your compliance with these Terms, KJClernt Games grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial entertainment purposes. This license does not include any resale or commercial use of the Platform or its contents.

We reserve the right to modify, suspend, or discontinue the Platform (or any part or content thereof) at any time with or without notice to you. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Platform.

4. User Conduct and Acceptable Use

When using the Platform, you agree not to engage in any of the following prohibited activities:

• Using the Platform for any illegal purpose or in violation of any local, state, national, or international law.
• Attempting to bypass, exploit, or modify the Auth0 authentication system or any security measures implemented by the Platform.
• Harassing, abusing, or harming another person, or attempting to do so, through our community features.
• Using any robot, spider, crawler, scraper, or other automated means or interface not provided by us to access the Platform or to extract data.
• Uploading, transmitting, or distributing any viruses, worms, or any software intended to damage or alter a computer system or data.
• Infringing upon or violating our intellectual property rights or the intellectual property rights of others.

5. Intellectual Property Rights

All content, features, and functionality on the Platform—including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software (collectively, "Content")—are the exclusive property of KJClernt Games, its licensors, or other content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as explicitly authorized in writing by KJClernt Games.

6. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by KJClernt Games. For instance, we utilize third-party services like Auth0 for authentication. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

You further acknowledge and agree that KJClernt Games shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. KJCLERNT GAMES EXPRESSLY DISCLAIMS ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT.

We make no warranty that the Platform will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.

8. Limitation of Liability

IN NO EVENT SHALL KJCLERNT GAMES, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (III) ANY CONTENT OBTAINED FROM THE PLATFORM; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

9. Termination

We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Platform.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
